Pocket Bikes and the Federal Government!

A pocket bike is a two-wheeled motorized device that has a seat or saddle for the driver's use and not designated or manufactured for road use.
pocket bikes do not include an all-terrain motorcycle as defined in section 436 of the Vehicle Code.

Is my "Pocket Bike" authorized on public lands? The short answer "No". Recent legislation bans pocket bikes being operated on public lands. Section 21 720 is added to the California Vehicle Code which read: "A pocket bike is not operated on a sidewalk, driveway, or any another component of a road, or a bikeway, bicycle path or trail, trail riding, hiking or recreational trail, or open public lands to road use of motor vehicles. "

What if I'm caught riding my "Pocket Bike" on Public Land? Legislation Recent allows peace officers to seize the bike and keep it for up to 48 hours. The offender shall be liable for all costs associated with disposal sequestration and storage.
In addition, new legislation requires that the manufacturer of pocket bike to put a sticker on the bike which reads as follows:

The pocket bike has purchased or obtained is strictly prohibited from driving on a sidewalk, driveway, or any other part of a road, or a bikeway, track or trail bike, trail riding, hiking or recreational trail, or on public land open to the use of off-road vehicles. A violation of this regulation may result in prosecution and seizure of the device.

Pocketbike are small motorcycles with engines of 40-49cc gasoline or electric motors. They are being improperly marketed and sold as motor scooters. "pocket bikes to the definition of a motorcycle as defined in California Vehicle Code 400 (a):

CVC 400 (a): A motorcycle is any motor vehicle having a seat or saddle for use of the pilot, designed to travel on not more three wheels in contact with the ground, and weighing less than 1500 pounds. As engines are pocket bikes under 150cc, They are further defined as a motor cycle "Driven" by CVC 405C

CV 405: A motor cycle "engine" means any motorcycle with an engine displacing less than 150 cubic centimeters.

A motor-driven cycle must be registered with the DMV for use on a public road or off-street public parking. The pilot will be issued a license valid driver's M1 (motorcycle) endorsement by CVC12500 (b) and CVC12804.9 (a). The pilot must wear a motorcycle helmet approved by CVC27803. The motor-driven cycle also must be equipped with all required safety equipment.

The DMV is not registered "pocket bikes" because of the lack of identification numbers requirements (Vehicle Identification Number and the number of motor). This means that "pocket bikes" can not be driving on public roads or off-street facilities.

If the pocket bikes are properly registered (if the DMV allows registration at a future date), riders must follow all road rules and requirements of any other equipment as you would any other motorcycle or vehicle, are subject to citations for violations observed by Officials of the department.

Pocket bikes may still be used on private property (areas not open to vehicular traffic public) urges pilots to get training in the safe handling of these vehicles and use appropriate safety equipment.

There are more agencies and organizations that are clamoring to define the pocket bikes and requests to increase the issue of regulations. Here is one of the American Association of Managers of Motor Vehicles.

Whereas, the American Association of Motor Vehicle Administrators (AAMVA) is an association representing its U.S. States and Canada, working in collaboration to support and improve motor vehicle administration, safety, security identification and compliance of law, and whose activities include the development of model programs in motor vehicle administration, police traffic and road safety, which serves as a clearinghouse for these same disciplines, and acting as the international spokesman for these interests, and

Whereas, in order to reduce collisions and traffic deaths and injuries resulting from traffic accidents, Congress has required the Federal Department of Transportation to establish minimum security standards for any motor vehicle manufactured primarily for use on public roads, has prohibited the manufacture, sale, importation and distribution of vehicles motor do not meet federal safety standards for motor vehicles and

Whereas, in response to the call of the Congress, the National Highway Traffic Safety Administration (NHTSA) has promulgated standards for motor vehicle safety in 49 CFR 571, including safety standards for motorcycles and motor cycles, and requires manufacturers to certify vehicles manufactured for use on the road comply with all applicable safety standards, and

Whereas, miniature motorcycles commonly referred to as "look like pocket bikes' traditional racing motorcycles in all respects except for their small size and bikes Pocket not conform to the specification of the minimum height for headlights, taillights, brake lights and turn signals for motorcycles or motor cycles, and

Whereas short stature pocket bikes made excessively difficult for other drivers to see when exploited in the right direction and

Whereas Some state laws specifically recognize pocket bikes and prohibit their operation on public roads in that state, but many state laws do not specifically recognize pocket bikes, regarding them as 'jet' that could be recorded and on public roads by qualified pilots, and

Whereas that lack of federal regulation, clear rules and guidelines applicable to pocket bikes has created confusion among law enforcement officials, administrators vehicles and state and local governments officials, and now, therefore, be:

Resolved by the Board of the American Association of Managers of Motor Vehicles, which considers that AAMVA, because pocket bikes do not meet federal safety standards for motor vehicles.

They are not "manufactured primarily for use on public roads "within the meaning of federal law, and also ruled that AAMVA shall seek to develop and strengthen relations with other security organizations and law enforcement agencies and national security organizations to promote awareness of safety concerns and ensure that state laws prohibit the operation of pocket bikes on public roads, and

Be it Further Resolved that jurisdictions should not title or register to movement road use of pocket bikes, mini-helicopter, motorcycle or any other standard that does not meet federal safety rules engine vehicle for vehicles intended for use on public roads, and has no manufacturer's label certifying that the vehicle meets all safety standards applicable in force on the date of manufacture, unless the state or federal law specifically exempts the vehicle of such standards and certification, and

Be resolved AAMVA provided further that this resolution to the CPSC, NHTSA, the National Traffic Law Center, and the National Conference of State Legislatures, governors Road Safety Partnership and other appropriate state and federal agencies.

Where does this leave homeowners pocket bike? Still, can be mounted but not on public roads, sidewalks or public land. However, they can be enjoyed on private property. The pilot and his parents must understand the pocketbike not a toy and therefore requires that ride responsibly including full head protection and protective clothing.
