If allowed to drive 47cc pocket bikes?

I live in Charlotte, North Carolina i plan to buy this bike http://www.minipocketrockets.com/mx3-pocketbike/ Its 47cc. Are you allowed to drive on the streets of his neighborhood or the sidewalk? At what age are you supposed to be?

On private property only. Not the street. Not on the sidewalk. It's a toy, there is no age limit for toys.
