2006 polaris sportsman 500, the throttle problem, serious injury?

my brother works at a local Honda dealer and recently purchased a polaris 2006 500 sportsman like trade in.he was instructed to pull the ATV business from the front of the store that is attached to the rear building proceeded to make a left turn very slowly in the shop and as he did the ATV was Full Throttle and it was, the ATV is still running all the bounce open to the sides of the wall and proceeded to climb another atv shop and flying until then landed brothers in the head while he was on the floor laying crushed nearly every bone in the face and other injuries and he is awaiting monday.they facial reconstruction are incident with security cameras and he's been there more six years without accident.they we were saying at first the throttle stuck and are now saying that the admission was not the proper way leading to motor unchecked, anyone have suggestions, similar problems, or anything.thanks
